Luke Oliphant Smith (21) was staying at Argyll and Bute Council’s homeless unit before being sent to jail.
Smith was given a three month sentence for defrauding two Cragroy residents, one 83 years old and the other 77. Smith took a collecting can to the Port Riddell sheltered housing complex and pretended to be raising funds for genuine charities – the Earl Haig Poppy Appeal and Dunoon Burgh Hall. One victim donated £1, and the other 50p.
At an earlier trial the court heard that Smith told arresting officers: ”I didn’t know what I was doing. I’m sorry.”
This offence was committed when Smith was under the terms of a probation order for a racist attack he committed at a shop in Dunoon’s Argyll Street in December, 2010. During the attack he racially abused staff and spat on a shop worker’s face.
Smith’s December, 2011 trail hear defence lawyer Ruben Murdanaigum say: He was desperate. He had no money and no food.”
Sheriff Ward deferred sentence on Smith until today, describing his actions as ‘despicable’.
At today’s hearing Mr Murdanaigum said: “What he has done is atrocious – he is aware of that” before telling the sheriff that Smith is seeking help for his alcohol problems and has embarked on a methadone programme to address his drug addiction.
After a long deliberation Sheriff Ward said: “When I imposed a probation order on you I gave you an explicit warning that if you breached it, it was likely you would receive a sentence of imprisonment.
“You not only breached it, you denied that you breached it.
“You will now have to face the consequences.”
Smith was sentenced to four months in jail for his racial abuse, and a further three months for fraud.
Smith looked stunned as he was led away and Sheriff Ward stopped him and his jailer saying: “All of that is because I consider there is no other appropriate way of dealing with you.”
